ORDER: (Per the Hon'ble the Chief Justice Ujjal Bhuyan)
None appears for the appellant on call, though
Mr.B.Mukherjee, learned counsel appears for respondents
No.3 to 5.
2. This appeal has been preferred against the
judgment and order dated 28.06.2013 passed by the
learned Single Judge allowing W.P.No.35948 of 2012. The
aforesaid writ petition was heard along with another writ
petition being W.P.No.35212 of 2012. Both the writ
petitions were allowed by the aforesaid common order.
3. Matter pertains to certification granted by the
Central Board of Film Certification for exhibition of Telugu
film called 'Denikaina Ready'. By the judgment under
appeal, the writ petitions were allowed by deleting certain
scenes from the aforesaid movie. On appeal, a Coordinate
Bench vide the interim order dated 28.11.2013 stayed the
aforesaid order on the ground that learned Single Judge
ought not to have entertained the writ petition since it
involved public interest at large.
4. Be that as it may, since the matter pertains to
exhibition of the film in the year 2012, we are of the view
that no live issue survives for adjudication at this distant
point of time.
5. Accordingly, writ appeal is closed as infructuous
by confirming the interim order dated 28.11.2013.
Miscellaneous applications pending, if any, shall
stand closed. However, there shall be no order as to costs.
