      CIVIL MISCELLANEOUS APPEAL No.887 of 2011

JUDGMENT: (Per the Hon'ble Dr.SA,J)

      This appeal, under Order 43 Rule 1(r) of CPC is filed by

the appellants, aggrieved by the order and decree, dated

07.06.2011 passed in I.A.No.201 of 2011 in O.S.No.1 of 2011

by the IX Additional District Judge at Kamareddy.


2.    Learned counsel for the respondent would submit that the

subject suit was disposed of by the Court below and therefore,

the cause in the appeal does not survive for adjudication.

3. Taking on record the said submission, the Civil

Miscellaneous Appeal is dismissed as infructuous.

Miscellaneous petitions pending, if any, shall stand closed.

There shall be no order as to costs.
