JUDGMENT:
Both the counsels are present.
2. O.S.No.118 of 1995 is filed for Specific performance and
Perpectual Injunction regarding house bearing No.3-13/111B
admeasuring an extent of 367 Sq. Yds situated at Srinivasnagar
Colony, Ramanthapur, Rangareddy District, in which the
defendant filed counter claim contending that the document relied
upon the plaintiff is not agreement of sale and it is only money
bond. The Trial Court after considering the evidence on both sides
of arguments dismissed Specific performance and decree counter
claim of the defendant with costs.
3. This appeal is preferred only against the order of the Trial
Court regarding the dismissal of the suit for specific performance,
but not against counter claim as such.
4. Learned counsel for the respondents contended that the
appeal is not maintainable considering the argument of the learned counsel for appellant, as admittedly, no appeal lies preferred
against the counter claim.
5. This court finds true and reasonable to dismiss the appeal.
6. In view of the above, the appeal is dismissed.
7. As a sequel, miscellaneous applications pending, if any, shall
stand closed.
