JUDGMENT:(per Hon'ble Sri Justice T.Vinod Kumar)

       Despite the matter being listed under the caption 'For Dismissal',

none appears on behalf of the appellant.

2.     Learned counsel appearing on behalf of the respondent would

submit that the appellant had filed a Memo dt.21.03.2013 into this

Court stating therein that in compliance with the order of this Court,

dt.15.02.2012 passed in C.A.No.390 of 2009, the amounts payable as

differential interest were calculated and deposited with the State Bank

of Hyderabad, High Court Branch, and that the bank had paid out the

same in favour of the respondent and thus, the OSA has become

infructuous.

3. Placing on record the above said submission made on behalf of

the respondent, since there is no representation on behalf of the

appellant, the OSA is dismissed for non-prosecution.

4. Miscellaneous petitions, if any, pending in this OSA shall stand

closed. No order as to costs.
