                  APPEAL SUIT No. 419 OF 1988


JUDGMENT:

1. This appeal is directed against judgment and decree in

O.S.No.228 of 1978.

2. In pursuance of direction given by this Court on

21.10.2022, the Registrar (Judicial) has submitted a report

stating that the verification of suit registers of Chief Judge, City

Civil Court, Hyderabad pertaining to the year 1978 shows that

142 suits were only registered and further, I Additional Chief

Judge, City Civil Court, Secunderabad, during the year 1978

was not institutional Court and the suits that were numbered in

the Chief Judge, City Civil Court, Hyderabad were made over to

that Court.

3. Similarly, verification of suit register of Additional Judge,

City Civil Court, Hyderabad was done and the said suit cause

title is not tallying with the cause title of this appeal.

4. There is no representation for the appellant as well as the

respondents. The records of the appeal are also not available

and it is also not possible to reconstruct the records since no

information and no documents are available. Further, appellant

and respondents are also not in a position to furnish any

records.

5. In the said circumstances, this appeal is closed giving

liberty to move an application in the event of records being

found. There shall be no order as to costs. As a sequel, pending

miscellaneous applications, if any, shall stand closed.
