     CIVIL MISCELLANEOUS SECOND APPEAL.No.17 of 2022

JUDGMENT:

1. Heard learned counsel for the appellant and learned counsel

for the respondent.

2. The present appeal is directed against the judgment and

decree dated 17.08.2022 in M.A.No.145 of 2021 on the file of

Court of the learned Chief Judge, City Small Causes Court,

Hyderabad, whereunder, the Court below dismissed the appeal

confirming the online demand notice dated 09.12.2021 issued by

the respondent-Corporation. Assailing the said judgment and

decree, the present appeal is filed.

3. Learned counsel for the appellant stated that, pending the

present appeal, there was a settlement between the appellant and

the respondent-Corporation and the principal tax amount was

also paid. Since, no cause of action survives in the present

appeal, learned counsel seeks to withdraw the appeal.

4. A perusal of the docket proceedings shows that the Order

dated 13.10.2022 passed by this Court is complied with.

Therefore, recording the submissions made by the learned

counsel for the appellant, the present appeal is dismissed as

withdrawn. No costs.

Miscellaneous applications, if any, pending shall stand

closed.
