         THE HONOURABLE SRI JUSTICE M.LAXMAN

     CIVIL MISCELLANEOUS SECOND APPEAL No.10 of 2017

JUDGMENT:

1. The present appeal has been directed against the judgment

and decree dated 10.04.2017 in M.A.No.367 of 2013 on the file

of the Chief Judge, City Small Causes Court, Hyderabad.

2. On the last date of hearing, when the matter was taken up

for hearing, there was no representation for the appellant, and

therefore, the matter was directed to be posted to today under

the caption 'for dismissal'. In spite of matter being listed today

under the caption 'for dismissal', there is no representation for

the appellant. This shows that the appellant is not evinced any

interest in prosecuting the case. Therefore, this appeal is liable

to be dismissed for non-prosecution.

3. Accordingly, this appeal is dismissed for

non-prosecution. There shall be no order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed.
