CRIMINAL APPEAL No.466 OF 2010
JUDGMENT:
This Criminal Appeal is filed by the Appellant/Accused
aggrieved by the conviction recorded by the Judge, Family Court,
R.R.District, FAC of Spl.Sessions Judge for SC & ST (POA) Act,
R.R.District, in S.C.No.147 of 2008, dated 17.03.2010, convicting
the accused for the offence punishable under Sections 297 of the
Indian Penal Code and Section 3(1)(x) of the SC & ST (POA) Act,
1989, and sentence of rigorous imprisonment for a period of three
months and one year, respectively.
2. Heard and perused the record.
3. During the course of arguments, learned counsel for the
appellant/accused submitted that the sole appellant in this case
i.e. Karre Mallaiah, S/o.Achaiah, died on 01.12.2020 and he filed
copy of the Death Certificate of the appellant/accused dated
15.12.2020, to that effect. Learned counsel submitted that in view
of the death of the sole appellant, the present Criminal Appeal
stands abated.
4. Learned Additional Public Prosecutor for the State Sri
S.Sudershan, on instructions would submit that the appellant
died.
5. In the light of the submissions made by both the learned
counsel for the appellant as well as the learned Additional Public
Prosecutor and in view of the Death Certificate of the
appellant/accused dated 15.12.2020, the Criminal Appeal is
dismissed as abated.
Miscellaneous applications, if any, pending shall stand
dismissed.
