CIVIL MISCELLANEOUS APPEAL No.727 of 2003
JUDGMENT:-
1. The present appeal assails the order dated 04.05.1996
passed in O.P.No.101 of 1991, on the file of the V Additional
Judge, City Civil Court, Hyderabad.
2. On 10.06.2022, this Court directed the appellant to take
out personal notice to the 1st respondent and file proof of service
without fail by the next date of hearing. When the matter came
up for hearing today, proof of service, as directed by this Court,
not filed and there is no representation from the appellant side.
Hence, direction of this Court had not been complied with.
This is an appeal of 2003. No diligency is exhibited by the
appellant or their counsel in prosecuting the case. Hence, it is a
fit case to dismiss the case for non-prosecution.
3. Hence, the appeal is dismissed for non-prosecution.
There shall be no order as to costs.
4. As sequel, miscellaneous petitions, if any pending, shall
stand closed.
