ORDER:-    (Per Hon'ble Sri Justice Abhinand Kumar Shavili)

1.     This Writ Petition is filed seeking a 'Writ of Certiorari' to

call for the records relating to and connected with order of the

A.P.Administrative Tribunal dated 18.11.2004 in O.A.No.3017 of

2004 and quash the same as unjust and further to direct the

official respondents to consider the case of the petitioner for

promotion to the post of Chief Engineer basing on the seniority

list of Executive Engineer dated 23.02.2000 published in

Gazette on 28.02.2000 in view of the judgment of this Court

dated 23.09.2003 in W.P.No.9301 of 2002 and batch with all

consequential benefits.

2. When the matter is taken up for hearing, learned counsel

for the petitioner as well as the learned Government Pleader for

Services-I Department have informed the Court that the

petitioner was aged about 57 years in 2004 and he was seeking

a direction to consider his case for promotion to the post of

Chief Engineer and at this point of time, he had retired from

service and in view of the same, no orders are to be passed.

3. This Court having considered the submission made by the

learned counsel for the petitioner is of the considered view that

the cause in the Writ Petition does not survive and accordingly,

the Writ Petition is closed. There shall be no order as to costs.

4. As a sequel, miscellaneous petitions, if any pending, shall

stand closed.
