COMMON JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
Learned counsel prays for withdrawal of the present writ
appeal as well as I.A.No.2 of 2021 with a liberty to file an
appropriate application in the pending civil suit i.e., O.S.No.76 of
2013. Learned counsel has fairly stated before this Court that the
order passed by the leaned Single Judge may come in his way in
respect of the civil suit, which is pending between the parties.
Resultantly, I.A.No.2 of 2021 as well as the writ appeal stand
dismissed as withdrawn. However, it is clarified that the order
passed by the leaned Single Judge will not come in the way of the
petitioner so far as the civil suit is concerned. The civil suit is
directed to be decided based upon the evidence adduced by the
parties.
Miscellaneous petitions, if any, shall stand closed. There
shall be no order as to costs.
