JUDGMENT

When the matter is taken up for hearing, there is no

representation for the party in person. Respondent counsel

present.

On 16.11.2022 and 15.12.2022, there is no

representation for the party in person and therefore, the matter

was directed to be listed today under the caption 'for dismissal'.

Today also, there is no representation for the party in person.

Therefore, this Court is of the considered view that the party in

person is not interested to pursue the litigation.

Hence, the Appeal is dismissed for non-prosecution. No

costs.

Pending miscellaneous applications, if any, shall stand

closed.
