JUDGMENT

When the matter is taken up for hearing, there is no

representation for the appellant.

Respondent's counsel present and stated that respondent

No.3 died and he also furnished details of respondent. No.3. As

the appellant failed to turn up on 01.12.2022, the matter was

directed to be listed today under the caption 'for dismissal'.

Today also, there is no representation for the appellant.

Therefore, this Court is of the considered view that the appellant

is not interested to pursue the litigation.

Hence, the Appeal is dismissed for non-prosecution. No

costs.

Pending miscellaneous applications, if any, shall stand

closed.
