CRIMINAL REVISION CASE No.838 OF 2022
JUDGMENT:
This revision is filed by the petitioner challenging the
Judgment of the Special Judge for Trial of Offences under
SCs and STs (POA) Act-cum-VI Additional metropolitan
Sessions Judge, Secunderabad in Crl.A.No.123 of 2021,
dt.20.10.2022, confirming the conviction imposed by the
XX Additional Chief Metropolitan Magistrate,
Secunderabad in C.C.No.100631 of 2018 dt.19.03.2021.
2. In revision both the parties have appeared before this
Court and sought indulgence of this Court in allowing the
revision on the ground of compromise.
3. Both the parties are present in person and identified by
their respective counsel. When questioned, the complainant/1st
respondent stated that he has no grievance since he has
received the entire amount.
4. The offence under Section 138 of the Negotiable
Instruments Act is compoundable.
5. In the said circumstances, the revision petition is allowed
on the ground of compromise setting aside the Judgment of
the Special Judge for Trial of Offences under SCs and STs
(POA) Act-cum-VI Additional metropolitan Sessions Judge,
Secunderabad in Crl.A.No.123 of 2021, dt.20.10.2022,
confirming the conviction imposed by the XX Additional
Chief Metropolitan Magistrate, Secunderabad in
C.C.No.100631 of 2018 dt.19.03.2021. However, the
petitioner has to pay Rs.10,000/- to the Telangana High Court
Legal Services Committee, Hyderabad, within one week from
the date of receipt of a copy of this order.
Miscellaneous Petitions, if any, pending, shall also stand
closed.
