WRIT PETITION No.44983 OF 2022
ORDER: (ORAL)
Heard Sri Padala Pravin Kumar, learned counsel for petitioner and the
learned Assistant Government Pleader for Home and perused the material on
record.
2. The petitioner is aggrieved by the action of the respondent Nos.3 and
4, not acting upon his complaint to take action against respondent Nos.5 to 7.
According to the petitioner even after lodging several complaints with respondent
No.4 viz., Station House Officer, Gummadidala Police Station, on 12.09.2017,
02.12.2022 and 10.12.2022 in connection with Ashoorkhana attached to the Waqf
properties i.e., graveyard and other properties situated at Gummadidala Village and
Mandal, Sanga Reddy District.
3. The learned Assistant Government Pleader for Home, submitted that
as per the records of respondent No.4, the complaints stated to have been lodged
by the petitioner, have not been received by the Police Station.
4. In the above circumstances, the writ petition is disposed of, directing
the petitioner to lodge a complaint by following procedure as prescribed under
Section 154 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.'). On receipt of such compliant, respondent No.4 shall conduct necessary inquiry and act
in accordance with law by following Supreme Court judgment in Lalita Kumari
vs. Government of Uttar Pradesh. No order as to costs.
As a sequel, miscellaneous applications, if any, pending in this writ
petition shall stand closed.
