CITY CIVIL COURTS APPEAL No.245 of 2001
JUDGMENT:
1. The present City Civil Courts Appeal has been directed
against the common judgment and decree dated 12.06.2001 in
O.S.Nos.1965 of 1997 and 84 of 2000 on the file of the Court of
learned VII Additional Senior Civil Judge, City Civil Courts,
Hyderabad. The present appeal is preferred against the judgment
and decree in O.S.No.1965 of 1997, which was filed seeking
partition of the house property and for consequential relief of
Perpetual Injunction. The Court below dismissed the Suit along
with O.S.No.84 of 2000. Assailing the same, the present Appeal is
filed.
2. This Court by Order dated 20.10.2011 directed the
appellants to bring the legal representatives of the respondents on
record, failing which, the appeal stands dismissed as abated and
liable for dismissal, for non-prosecution. Till date, the legal
representatives are not brought on record.
3. There is no representation from both the learned counsel on
14.12.2022. Hence, this Court directed to list the matter under
the caption, "for dismissal". Today i.e., on 16.12.2022, there is no
representation on behalf of the appellants.
4. In the said circumstances, the City Civil Courts Appeal
stands abated and dismissed for non-prosecution. No costs.
Miscellaneous Petitions, pending if any, shall stand closed.
