ORDER: (Per Hon'ble Sri Justice Abhinand Kumar Shavili)
When the matter is taken up for hearing, learned
counsel appearing for the petitioner has informed this
Court that the promotion of the petitioner was set aside
by the Andhra Pradesh Administrative Tribunal (for
short, 'the Tribunal') in O.A.No.5855 of 2008 dated
04.11.2011 at the instance of contesting respondents.
Aggrieved by the said orders passed by the Tribunal the
present Writ Petition is filed.
However, this Court was pleased to suspend the
operation of Tribunal judgment vide orders dated
12.12.2011 and by virtue of Interlocutory Orders, the
petitioner was allowed to continue in the promoted post
and petitioner has retired from service during the
pendency of the Writ Petition.
In view of the same, this Court is of the considered
view that the cause in the Writ Petition does not survive,
as the grievance of the petitioner has already been
resolved by passing of Interlocutory Order by this Court.
Accordingly, the Writ Petition is closed. No
costs.
Miscellaneous petitions, if any, pending shall stand
closed.
