      Heard. Perused the record.

2.    In the course of submissions, it is brought to the notice of

this Court by the learned counsel for the appellant that the

subject suit in O.S.No.49 of 2012 was dismissed without costs on

29.10.2021

. The online case status of the subject O.S.No.49 of

2012 placed before this Court by the Registry also reveals the

same.

3. In view of these circumstances, the cause in the appeal

does not survive for adjudication.

4. Accordingly, this Civil Miscellaneous Appeal is dismissed as

infructuous. No order as to costs.

As a sequel, miscellaneous petitions pending, if any, in this

appeal, shall stand closed.
