ORDER:

This writ petition is filed for the following relief:

".......to issue any writ, order of direction, more particularly one in nature of Writ Mandamus declaring the action of the respondent No.1 in issuing the proceedings dated 05.06.2010 vide proceedings No.APERC/SECY.JT.DIR(TARIFF-ENGC)/No.05, 06, 07, 08 thereby purportedly determining and approving Fuel Surcharge Adjustment (FSA) for the financial year 2008-2009 (April, 2008 to March, 2009) contrary to Regulation No.1 of 2003 and without any notice or public hearing as required by law as being arbitrary, illegal without jurisdiction or power, and in violation of principles of natural justice"

2. The Learned Counsel for the petitioner and Sri R.Vinod

Reddy, Learned Standing Counsel for T.S.TRANSCO appearing

for respondents, submitted that the judgment passed by the

Hon'ble Supreme Court in Sai Bhaskar Iron Ltd., Vs.

A.P.Electricity Regulatory Commission, 1 squarely covers the

issue raised in the instant case and therefore, this Writ petition is

liable to be dismissed.

3. Accordingly, the Writ Petition is dismissed. No

order as to costs.

4. Pending miscellaneous applications, if any, shall stand

closed.
