JUDGMENT:     (Per the Hon'ble the Chief Justice Ujjal Bhuyan)



      Heard Ms. Pramada, learned Government Pleader for Forests

for the appellant and Mr. V.Rohith, learned counsel representing

Mr. V.Ravi Kiran Rao, learned counsel for the respondents.

2. This writ appeal by the State is directed against order

dated 07.03.2007 passed by the learned Single Judge dismissing

the writ petition filed by the State (appellant).

3. The Writ Petition was filed by the State assailing the

order of the II Additional District Judge (FTC), Adilabad dated

31.08.2004 in C.M.A.No.6 of 2002 directing release of the seized

vehicle of the respondents.

4. When the appeal was filed, the appellate Court passed

an order on 12.10.2007 on the interlocutory application filed by

the appellant State. By the aforesaid order this Court directed

release of the vehicle in question on furnishing of bank guarantee 2 HCJ & CVBRJ W.A.No.845 of 2007

of Rs.2,50,000.00 by respondent No.1 to the satisfaction of Forest

Range Officer, Mancherial, Adilabad District.

5. We have been informed that on furnishing of such

bank guarantee, the vehicle was released to the respondents.

6. That being the position, we feel that there is hardly any

issue left for adjudication, that too at this distant point of time.

More so, the bank guarantee furnished may have already spent its

utility. Therefore, we are not inclined to continue with the appeal

proceedings.

7. Writ Appeal is accordingly disposed of. However, there

shall be no order as to costs.

8. As a sequel, miscellaneous applications pending, if

any, in this Writ Appeal, shall stand closed.
