JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
The present writ appeal is arising out of an ex parte
interim order dated 20.07.2021 passed in W.P.No.16545
of 2021.
The learned Single Judge has passed the ex parte
order directing the official respondents therein not to
issue the No Objection Certificate/Occupancy Right
Certificate in favour of the appellant.
Undisputedly, as stated by the learned counsel for
the appellant, no application for vacating the stay order
has been filed and, therefore, he prays for grant of liberty
to file an appropriate application for vacating the stay
order in the matter enabling the learned Single Judge to
pass appropriate orders on merits.
The writ appeal stands disposed of with a liberty to
the appellant to file an application for vacating the stay
order and the learned Single Judge is requested to pass
appropriate orders within a period of thirty days from
today, after hearing both the parties.
The miscellaneous applications pending in this
appeal, if any, shall stand closed. There shall be no
order as to costs.
