JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
The present writ appeal is arising out of an interim
order dated 29.06.2021 passed by the learned Single Judge in
W.P.No.14432 of 2021.
It has been argued before this Court by the appellant
that an ex parte interim order has been passed in the Writ
Petition suspending the layout sanctioned in favour of
respondent No.7 to the writ petition/appellant herein.
Learned counsel for the other side informed this Court
that an application for vacating the stay is also pending
before the learned Single Judge.
At this stage, learned counsel for the parties have fairly
stated before this Court that the learned Single Judge be
requested to decide the application for vacating the stay at an
early date, preferably, within thirty (30) days from today.
However, without going into the merits of the case, the
Writ Appeal stands disposed of with a request to the learned
Single Judge to decide the application for vacating the stay
within a period of thirty (30) days from today. The parties are
directed to appear before the learned Single Judge on
29.10.2021.
Office is directed to list the matter before the learned
Single Judge on 29.10.2021.
The miscellaneous petitions pending in this appeal, if
any, shall stand closed. There shall be no order as to costs.
