Judgment: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
The present Writ Appeal is arising out of Order
dated 15.03.2021, passed by the learned Single Judge, in
W.P.No.5820 of 2021.
2. The facts of the case reveal that the writ petitioner- Easam
Seethamma has filed the Writ Petition stating that respondents
No.8 and 9 in the Writ Petition, have constructed an
unauthorised structure and she has submitted a representation on
05.03.2021. However, her representation is not being looked
into. The learned Single Judge has directed the official
respondents to decide the petitioner's representation, against
which the present appeal has been filed.
3. Learned counsel for the appellant/third party to the writ
petition stated before this Court that he is also having interest in
the same property and therefore, he should also be heard while
deciding the matter.
4. Resultantly, without adverting to the merits of the case, the
present Writ Appeal is disposed of. The official respondents are
directed to hear the present appellant as well as the writ
petitioner and the private respondents before passing a final
order in the matter.
5. Parties are directed to appear before respondent No.8 on
15.11.2021.
Consequently, Interlocutory Applications, pending if any,
stand dismissed.
