Judgement Date : 24 March, 2021

Telangana High Court
Bharatiya Janatha Partybjp vs The Election Commission Of India ... on 24 March, 2021
Bench: Hima Kohli, B.Vijaysen Reddy
Item No.19

THE HON'BLE THE CHIEF JUSTICE HIMA KOHLI
                                           AND
THE HON'BLE SRI JUSTICE B. VIJAYSEN REDDY

                                  W.A.No.515 of 2020

JUDGMENT: (Per the Hon'ble the Chief Justice Hima Kohli)

1.

On the last date of hearing, a request for an adjournment was made by

learned counsel for the appellant on the ground that learned Senior Advocate

engaged by him was unavailable. Today, learned counsel states that he has

been detected with COVID-19 infection and is unable to address arguments.

2. We may note that the order impugned in the present appeal has been

passed on an interim application moved by the appellant in W.P.No.19485 of

2020 seeking stay of issuance of Election Notification in relation to Greater

Hyderabad Municipal Corporation elections pending disposal of the writ

petition, which was declined. As the elections are already over, there is no

good reason for us to keep the present appeal alive that too when the interim

relief prayed for by the appellant in the application virtually overlaps the main

relief prayed for in the writ petition, which is still pending adjudication.

3. We therefore decline to entertain the present appeal. The same is

disposed of along with the pending applications, if any.
