COMMON ORDER:
This Appeal arises out of judgment dated 26.08.2002
rendered by the learned V Senior Civil Judge, City Civil Court,
Hyderabad in O.S.No.1526 of 1994.
I.A.No.1 of 2021 is filed under order 23 Rule 3 read with
Section 151 C.P.C. with a prayer to record the compromise and
allow the Appeal in terms thereof.
Both the parties are present in the Court and produced their
respective identity proofs. They are all identified personally by the
learned counsel appearing for them. They stated that on the advise
of the elders, they had settled the dispute among themselves and all
of them agreed that out of their own free will and volition, they have
entered joint memorandum of compromise, which was reduced into
writing on 28.01.2021.
Hence, I.A.No.1 of 2021 is ordered and the Appeal is disposed
of in terms of memorandum of compromise. The parties to bear their
own costs. The terms of compromise shall form part of the order. It is
made clear that in terms of the compromise entered between the
parties, respondent No.2-plaintiff No.2 is entitled to withdraw the
money deposited by the appellant to the credit of the suit in terms of
the order dated 25.11.2002 passed by this Court in CMP No.22527
of 2002.
Miscellaneous petitions, if any pending, shall stand disposed
of.
