WRIT APPEAL No.163 of 2021
JUDGMENT: (Per the Hon'ble the Chief Justice Hima Kohli)
1. The appellant (petitioner in W.P.No.86 of 2021) is aggrieved by
a common order dated 15.02.2021 passed by the learned Single Judge
on two miscellaneous applications moved in the captioned writ
petition and W.P.No.2967 of 2021 filed by one Sri A. Anjaiah Goud
whereunder, the statement of learned Standing Counsel for HMDA
has been recorded to the effect that necessary proceedings are ready to
be issued, but due to the pendency of the writ petitions, the same
could not be issued. The learned Single Judge has clarified that the
official respondents are at liberty to pass necessary orders and
communicate the same to the parties and the said proceedings shall
not be kept pending on the ground that the writ petitions are pending
before the court.
2. After addressing arguments for some time, Mr. Bankatlal
Mandhani, learned counsel for the appellant states that he may be
permitted to withdraw the appeal while reserving the right of his client
to approach the learned Single Judge for passing appropriate orders
for modification/vacation of the impugned order.
3. Leave, as prayed for, is granted. The present appeal is disposed
of as not pressed along with the pending applications, if any.
