THE HON'BLE THE CHIEF JUSTICE HIMA KOHLI
AND
THE HON'BLE SRI JUSTICE B. VIJAYSEN REDDY
W.A.No.588 of 2020
JUDGMENT: (Per the Hon'ble the Chief Justice Hima Kohli)
1. We are informed by learned counsel for the petitioner that in
terms of the award dated 18.12.2002, passed by the Labour Court, the
appellants had reinstated the respondent No.1 on 13.04.2003, but
compliance of the impugned award as regards grant of continuity of service and attendant benefits, was not made. Instead, a writ petition was preferred by the appellants after three years of passing of the impugned award, which came to be dismissed by the impugned order dated 08.11.2018. The appellants have taken another year and half to prefer the present appeal.
2. After addressing arguments for some time, learned counsel for the appellants states that he may be permitted to withdraw the present appeal and comply with the directions issued in the impugned judgment.
3. In view of the submission of learned counsel for the appellants, the appeal is disposed of along with the pending applications. It is expected that the appellants shall implement the impugned award within six weeks from today.
