      Contempt Case Nos.1249 & 1373 of 2021

COMMON ORDER:

     Both    these   Contempt    Cases   are   filed   alleging

violation of orders passed by this Court in W.P.Nos.13494

& 13912 of 2020 dated 06.11.2020.


      Heard learned counsel for the petitioner and learned

Government     Pleader   for   Forests   appearing     for   the

respondents.

In this case, it is to be seen that subsequent to the

passing of the orders dated 06.11.2020 in W.P.No.13494

of 2020, the respondents have issued proceedings dated

11.11.2020 and petitioner filed W.P.No.4506 of 2021

challenging the same and the said writ petition was

disposed of on 23.08.20021. Aggrieved by the same,

W.A.No.618 of 2021 is also filed and same was allowed by

judgment dated 29.11.2021 remanding the matter to the

learned Single Judge and the same is pending.

Though it is submitted by the learned counsel for

the petitioner that proceedings dated 22.07.2020 were set

aside in W.P.No.13494 of 2020 and before that order is

communicated, the respondents have passed an order

dated 11.11.2020 relying on the very same order dated 22.07.2020, but now, the petitioner has challenged the

order dated 11.11.2020.

Learned Government Pleader for Forests submits

that the respondents are not aware of the orders passed

on 06.11.2020, as such, no willful disobedience or violation

of the orders passed by this Court. She also submits that

since order dated 11.11.2020 is passed, unless the

petitioner pays compounding fee, her application for

renewal cannot be considered.

In this case, it is to be seen that the proceedings

dated 11.11.2020 are the subject matter of W.P.No.4506

of 2021. Therefore, the petitioner can raise all the

grounds raised in these contempt cases in the said Writ

Petition.

In view of above facts and circumstances, I do not

see any ground to entertain the contempt cases, as there

is no willful violation of the order passed by this Court.

Accordingly, both the Contempt Cases are disposed of

granting liberty to the petitioner to raise all the grounds

raised herein in W.P.No.4506 of 2021 and also to pay the

compounding fee, as per law, if she is so advised.

There shall be no order as to costs. As a sequel

thereto, miscellaneous petitions, if any, pending in these

Contempt Cases, shall stands closed.
