Citation : 2021 Latest Caselaw 4410 Tel
Judgement Date : 16 December, 2021
THE HON'BLE THE CHIEF JUSTICE SATISH CHANDRA SHARMA
AND
THE HON'BLE SRI JUSTICE N. TUKARAMJI
I.A.No.1 of 2019 In/And W.A.No.217 of 2019
COMMON JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
The delay in representing the appeal is condoned, but the
fact remains that there is a delay of 349 days in filing the appeal.
As usual, the statement made in the application for
condonation of delay i.e., I.A.No.1 of 2019 is that because the file
was misplaced, the appeal was not filed in time.
This court has yet to see an appeal filed by the Telangana
State Road Transport Corporation in time. In each and every case,
appeals are being filed with delay and the day-to-day delay is not
explained by the Corporation.
This court does not find any reason to condone the delay and
I.A.No.1 of 2019 is accordingly dismissed. As a consequence, the
appeal fails and the same is rejected.
Pending miscellaneous applications, if any, shall stand
closed. There shall be no order as to costs.
