JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
The present writ appeal is arising out of the order dated
23.06.2021 passed by the learned Single Judge in
W.P.No.14003 of 2021.
The undisputed facts of the case reveal that the writ
petition was disposed of without issuing any notice to the
present appellant (respondent No.5 in the writ petition) and
the contention of the present appellant (respondent No.5 in
the writ petition) is that there was suppression of facts in the
writ petition and he ought to have been given an opportunity
of hearing by the learned Single Judge before passing the
impugned order.
This court has carefully gone through the order passed
by the learned Single Judge. Undisputedly, without issuing
any notice and without hearing the present appellant
(respondent No.5 in the writ petition), the impugned order has
been passed.
Resultantly, the order dated 23.06.2021 passed by the
learned Single Judge in W.P.No.14003 of 2021 is set aside.
The parties are directed to appear before the learned Single
Judge on 20.12.2021. Office is directed to list the writ
petition before the learned Single Judge on 20.12.2021.
With the aforesaid, the writ appeal stands disposed of.
Miscellaneous petitions pending, if any, shall stand
closed. There shall be no order as to costs.
