       THE HONOURABLE SRI JUSTICE M.LAXMAN

               APPEAL SUIT No.4013 of 2004

JUDGMENT:

In spite of posting the matter today under the caption

'for judgment', there is no representation for the appellants.

The appeal is pertaining to 2004 and the suit is of 1998. On

account of stay granted by this Court in the present appeal,

passing of final decree by the trial Court was stalled.

In the said circumstances, the Appeal Suit is dismissed

for non-prosecution. There shall be no order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed.
