JUDGMENT :

1. I.A.No.1 of 2018 is filed to bring on record the legal

representatives of appellant No.1, who died on 21.01.2018. The

present application is filed on 17.04.2018, which is within time.

The original suit O.S.No.1160 of 1988 is filed for partition of the

plaint schedule property. Hence, the cause of action survives.

Therefore, this application is ordered.

Registry is directed to carryout necessary amendment.

2. I.A.No.1 of 2021 is filed to record the terms of

compromise mentioned in the Joint Terms of Compromise.

The appellants as well as the respondents along with their

respective counsel are present before this Court. Their identity

is also verified and found correct. Both the parties stated that

they have voluntarily signed on the Joint Terms of

Compromise. It is also stated that they have agreed to the terms

of compromise recorded. Therefore, this application is also

ordered.

In the light of the above said submissions, recording the

terms of compromise mentioned in the Joint Terms of ML, J

Compromise, this Second Appeal is disposed of in terms of

Joint Terms of Compromise. No order as to costs.

Miscellaneous petitions pending, if any, shall stand

closed.
