2021 Latest Caselaw 4099 Tel

Citation : 2021 Latest Caselaw 4099 Tel
Judgement Date : 2 December, 2021

Telangana High Court
Urbanwoods Kesington Llp Llp vs The State Of Telangana, on 2 December, 2021
Bench: A.Abhishek Reddy
THE HON'BLE SRI JUSTICE A.ABHISHEK REDDY

WRIT PETITION No. 31631 of 2021
ORDER:

Heard the learned counsel for the petitioner and the learned

Government Pleader for Revenue for the respondents. With their

consent, the Writ Petition is disposed of at the admission stage.

2. In this writ petition, the petitioner challenges the action of

respondent No. 4 in refusing to register the Plot bearing Nos. 51 & 52,

admeasuring 300 sq.yds. in Sy. No. 27/2, situated at Khajaguda

Village, Serilingampally Mandal, Ranga Reddy Districe vide refusal

order No. 124 of 2021, dated 10.06.2021 in respect of pending

document No. P.626/2021 on the ground that as per the list sent by the

District Collector, Ranga Reddy District, the subject property is

classified as assigned land.

3. Admittedly, in this writ petition, the petitioner did not choose to

challenge the notification issued by the District Collector, whereby the

subject property is categorized as assigned land under Section 5(2) of

the Telangana Assigned Lands (Prohibition of Transfers) Act, 1977.

However, the learned counsel for the petitioner has relied on the

judgment of this Court dated 25.08.2014 in W.P. No. 19069 of 2014

contending that the subject matter is covered by the said judgment. A

perusal of the said judgment shows that the subject land in that writ

petition pertains to Hafeezpet Village. Unless the petitioner

challenges the notification issued by the District Collector classifying

the subject land as 'assigned land', the relief as sought for in the

present writ petition cannot be granted.

4. Accordingly, the writ petition is dismissed.

Pending miscellaneous petitions, if any, shall stand closed.

There shall be no order as to costs.
