JUDGMENT: (Per the Hon'ble the Chief Justice Hima Kohli)

Learned counsel for the appellant states that the present appeal
may be disposed of in terms of an order dated 17.02.2021 passed in
W.A.No.198 of 2020 wherein, the very same order dated 03.02.2020
was assailed as assailed in the present appeal.
2. In the order dated 17.02.2021, the statement made by learned
counsel for the appellant was recorded to the effect that during the
pendency of the appeal, the appellant has submitted himself to a
physical test of induction as Home Guard and his candidature was
rejected. Thereafter, he had preferred a writ petition assailing the
rejection order that is pending before the learned Single Judge. In
view of the submission made above, leave was sought to withdraw the
captioned appeal and same was granted.
3. Learned counsel for the appellant states that even in the present
case, the appellant has already submitted himself to a physical test of
induction as Home Guard and his candidature has been rejected.
Thereafter, the appellant has preferred a writ petition to assail the
rejection order, which is pending consideration before the learned
Single Judge. He therefore seeks leave to withdraw the present
appeal.
4. Leave, as prayed for, is granted. The present appeal is disposed
of as not pressed along with the pending applications, if any.
