WRIT APPEAL Nos.394 and 467 of 2019
COMMON JUDGMENT: (Per the Hon'ble the Chief Justice Hima Kohli)
1. After addressing lengthy arguments assailing the common order
dated 21.12.2018, passed by the learned Single Judge dismissing
W.P.(TR).No.6062 of 2017 filed by the appellants/writ petitioners and
allowing W.P.No.9903 of 2017 filed by the respondents No.5 to 7
whereunder, family pension has been denied to the appellants and
it has been held that the respondent No.5 is entitled to receive family
pension including the arrears of family pension on the demise of
late Sri P.Manik Rao, an employee of the respondent No.3/GHMC,
learned counsel for the appellants seeks leave to withdraw the present
appeal (W.A.No.394 of 2019) and states that instead, the appellants
shall approach the Civil Judge for grant of a succession certificate in
their favour.
2. Without commenting on the maintainability or the merits of
such a petition proposed to be filed by the appellants, W.A.No.394 of
2019 is disposed of as not pressed.
3. Since learned counsel for the appellants states that besides
W.A.No.394 of 2019, the appellants have also preferred W.A.No.467
of 2019 against the impugned common order dated 21.12.2018 passed
in W.P.(TR).No.6062 of 2017, the said appeal is also disposed of as
not pressed.
