                                   ORDER

I.A. No.01 of 2024 is an application seeking withdrawal of the instant Appeal filed by the Appellant. Learned Legal Aid Counsel for the Appellant submits that the Appellant was convicted vide the Judgment of the Court of Learned Special Judge (POCSO), West Sikkim, at Gyalshing, dated 30-09-2023, in Sessions Trial (POCSO) Case No.12 of 2022 (State of Sikkim vs. Lakpa Tenzi Sherpa) and was sentenced to undergo simple imprisonment for a term of five years and to pay a fine of ₹ 5,000/- (Rupees five thousand) only, under Section 9(n) punishable under Section 10 of the Protection of Children from Sexual Offences Act, 2012, with a default stipulation. That, the Appellant is satisfied with the sentence imposed on him and does not seek to pursue the Appeal.

Not opposed.

Considered and ordered accordingly.

In the said circumstances, the Appeal stands disposed of as withdrawn.

Copy of this Order be transmitted forthwith to the Learned Trial Court along with its records.
