                                  ORDER

Learned Counsel for the Appellant has filed I.A. No.01 of 2024, which is an application seeking withdrawal of Crl.A. No.02 of 2024 (Karma Bhutia vs. State of Sikkim). The application is supported by an Affidavit. It is submitted by Learned Counsel that the Appellant had preferred the instant Appeal challenging the Judgment dated 30-10- 2023 and Order on Sentence dated 31-10-2023, of the Court of the Learned Special Judge (POCSO Act, 2012), in Sessions Trial (POCSO) Case No.24 of 2020 (State of Sikkim vs. Karma Bhutia). That, the Appellant now desires not to pursue the instant matter and seeks to withdraw the instant Appeal.

Learned Additional Public Prosecutor has no objection to the prayer.

Considered submissions, in view of the voluntary prayer made by Learned Counsel for the Appellant as instructed by the Appellant, the Appeal stands disposed of as withdrawn as also the I.A. (supra).

Copy of this Order be transmitted forthwith to the Learned Trial Court along with its records.
