ORDER
Learned Counsel for the Appellant submits that admittedly the points raised in the instant Appeal have already been considered and decided by this Court in The Branch Manager, National Insurance Company Limited, Gangtok vs. Master Suraj Subba and Another:AIR 2014 Sik 7 and in The Branch Manager, United Insurance Co. Ltd. vs. Lily Ongmu Lepcha:MANU/SI/0058/2016:2017 ACJ 2224. That, the Judgments of this Court supra, have remained unassailed. That, in view of the said circumstance, he may be permitted to withdraw the Appeal.
Learned Counsel for the Respondents have no objection to the prayer for withdrawal.
