1. Heard.

2. The present criminal revision petition has been directed

against conviction and sentence imposed under Section 138 of the

Negotiable Instruments Act, 1881 by the learned Special Judicial

Magistrtate (NI Act Cases) No.5, Udaipur vide order dated

27.02.2024 (Case No. 4085/2019) and the conviction and

sentence was confirmed in appeal by the learned Special Judge,

SC/ST Act Cases, Udaipur vide order dated 05.11.2024 (Appeal

No. 103/2024).

3. Learned counsel for both parties are present, however, the

parties are not present before this Court.

4. Learned counsel for both parties confirmed that in terms of

the compromise, the compensation amount of Rs.3,25,000/- was

given to the private respondent No. 2 - complainant and Mr. Dilip

Vidoya, learned appearing on behalf of the private respondent No.

2 - complainant confirms that the cheque has been honoured and

the amount has been credited in the account of respondent No.2.

5. Recording the same, the instant criminal revision petition is

allowed. Consequently, the conviction and sentence imposed by

the trial court as confirmed by the appellate court is set aside. The

accused-revisionist (Mangilal) is acquitted from the charge.

6. All pending applications, if any, stand disposed of.
