1. The instant application has been preferred seeking

restoration of the appeal bearing S.B. Criminal Appeal

No.350/2023.

2. The appeal filed by the appilant has been dismissed by the

Registry in pursuance of the direction passed by the co-ordinate

Bench of this Court on 04.11.2024 whereby the counsel was

obligated to comply the order dated 09.04.2024. As per the office

report, required fresh addres could not file within stipulated time

as granted by this Court on 09.04.2024, therefore, on 10.01.2025,

the office dismissed the above criminal appeal.

3. I have heard the learned counsel for the appilante.

4. I am of the view that a lis raised by a litigant must be

decided on merits instead of trivial, technical lapses and grounds

Accordingily, the instant misc. application is allowed. The
