The present criminal misc. petition has been filed by the

petitioner being partially aggrieved by order dated 06.12.2026. He

submits that the learned trial Court has although permitted the

petitioner to undertake the B.A. Final Year Examination in judicial

custody, which are scheduled to be held on 10.02.2026, however,

at the same time imposed condition of depositing the expenses.

Mr. Kesa Ram, uncle of the petitioner, present in person,

states that the petitioner is a poor person and he is a student,

therefore, the condition of deposition of the expenses is onerous

one. He submits that the trial is pending and the petitioner is

seeking permission only to study further. Hence, in the interest of

justice, such conditions may be waived.

This Court has considered the matter and has gone through

the order dated 06.02.2026.

Admittedly the petitioner is a student and is seeking

permission to study further and appear in examination. In such

circumstances, imposing the condition of deposition of expenses

upon a student is onerous and not justified. The petitioner has

right to undertake his studies. Therefore, in the interest of justice,

the order dated 06.02.2026 passed by the learned trial court is

modified to the extent that the petitioner shall not be liable to pay

the expenses and he is permitted to undertake the examinations

in judicial custody on 10.02.2026.

With these observations, the instant criminal misc. petition is

allowed.

All pending application(s), if any, stand disposed of.
