Order

10/04/2026

1. This petition has been filed by the petitioner aggrieved of the

order dated 05.01.2024 passed by the learned Civil Judge,

Deedwana, District Nagaur, in Civil Original Suit No. 29/11 titled

"Sri Maheshwari (Soni) Charitable Trust Versus Laxmanram &

Ors.", whereby the learned Court below has closed the cross-

examination of witness Mahendra Meena (Tehsildar/Respondent

No.8).

2. Learned counsel for the respondents submits that the order

passed by the learned trial Court dated 05.01.2024 may be set

aside and the application filed by the petitioner may be allowed,

for which, he has no objection.

3. Further submissions, have been made, the learned trial

Court be directed to expedite the suit.

4. In view of the submissions made, whereby counsel appearing

for the respondents has prayed for accepting the writ petition filed

by the petitioner, the writ petition is allowed.

5. The order dated 05.01.2024 is set aside. The petitioner is

directed to keep the witness Mr. Mahendra Meena ready along with

the affidavit on the next date of hearing i.e. 22.04.2026 for cross-

examination and upon doing so, the learned trial Court is directed

to permit the petitioner to cross-examination the witness in Civil

Original Suit No. 29/11 titled "Sri Maheshwari (Soni) Charitable

Trust Versus Laxmanram & Ors.".

6. In view of the fact that the suit was filed way back in the

year 2011 and the same is still pending, the learned trial Court is

directed to expedite the trial of the Suit.

7. Accordingly, the writ petition is disposed of.

8. It is made clear that no further opportunity shall be granted

to the petitioner to cross-examine the said witness.

9. The stay application and all pending applications, if any, also

stand disposed of.
