1. Writ petitions being S.B. Civil Writ Petition Nos.827/2022,
848/2022, 863/2022, 878/2022, 1094/2022, 1100/2022,
1104/2022, 1301/2022, 8573/2023, 8576/2023, 8577/2023,
8578/2023, 8579/2023, 8580/2023, 8581/2023 and 8582/2023
have been filed by the Ananta Charitable Education
Society/College with a prayer for allotment of seats to the college
qua different streams of education. The writ petitions have been
filed for different sessions, to be specific, sessions for the years
2021-22, 2022-23 and 2023-24.
2. Writ petitions being S.B. Civil Writ Petition Nos.14541/2025,
5625/2025, 5932/2025 and 14543/2025 have been filed by the
students who were afforded appointments on the seats as allotted
to the College in pursuance to the interim orders.

3. Vide interim orders passed on different dates, the provisional
allotment of seats was permitted to the College. In pursuance to
the said interim orders, the seats as prayed for were even
provisionally allotted to the college.
4. However, subsequent to passing of the interim orders, the
National Medical Commission (NMC) withdrew the permission itself
as granted to the petitioner College vide order dated 14.04.2022.
5. Admittedly, the petitioner College preferred a writ petition
challenging the said order. Vide order dated 18.01.2024, while
allowing S.B. Civil Writ Petition No.6068/2022 along with other
connected writ petitions, a Co-ordinate Bench of this Court
proceeded on to quash order dated 14.04.2022. The Court vide
order dated 18.01.2024 observed, held and directed as under:
"RELIEF
16. In view of the discussion and the conclusion herein above,
while reconciling competing interests, at the same time keeping in
mind principles of justice and equity, the instant bunch of writ
petitions, except S.B. Civil Writ Petition No. 9625/2022, is
disposed with following directions :-
16.1. Various interim orders passed in the present writ
proceedings, more particularly, the orders dated 28.04.2022 and
21.09.2022, mentioned in the table contained aforesaid in the
preceding part, are made absolute, with consequences to follow.
16.2. Impugned orders dated 18.04.2022 and 14.04.2022 passed
by MARB in respect of all the four colleges i.e. Geetanjali Medical
College and Hospital, Ananta Charitable Educational Society,
Pacific Institute of Medical Sciences and American International
Management Ltd. assailed in CWP No. 6068, 6069, 6349 and
9364, respectively to extent of retrospectively cancelling
admissions already granted, are quashed.

16.3. Pursuant to decision dated 11.05.2022, (referred in para-7
of judgment), those of the students who have been adjusted in
other colleges shall continue to study in the same colleges and
there shall be no interruption in their future continuation in the
colleges alloted to them.
16.4. If it so desires, NMC is at liberty to proceed further to
consider the recommendations of the MARB made in the
impugned orders, in accordance with law.
16.5. In case the MARB/NMC subsequently finds the medical
colleges to be lacking in any manner, they shall be at liberty to
proceed against the erring medical colleges/institutions in
accordance with law. Making of the interim order absolute shall
not be construed as any shield by any medical college to not
comply with the future directives, if at all need arises on the part
of MARB/NMC to issue the same for imparting better medical
education in the interest of students.
17. As regards SBCW No.9625/2022, the petitioner college has
sought direction against the respondents to allow it to make
admissions for PG courses for the academic session 2022-2023,
same seems to have been rendered infructuous and is disposed of
accordingly. Petitioner is at liberty to approach MARB/NMC for
future admission permissions, if so required.
18. Disposed of in above terms. All pending applications also
stand disposed of."
6. Admittedly, order dated 18.01.2024 was not assailed further.
7. This Court is of the clear opinion that after the above order
been passed, nothing survives in the present petitions.
8. Counsel Mr. Saluja appearing for NMC although at the first
instance submitted that he has oral instructions to give consent
for confirmation of the interim orders passed in the writ petitions
and to get the writ petitions disposed of but then prayed for time
to get the instructions in writing.

9. This Court is of the opinion that once the order of
retrospective cancellation of admission has already been set aside
vide order dated 18.01.2024, there definitely survives nothing in
the present writ petitions. Further, by virtue of interim orders, the
provisional allotment of seats was made to the College and the
students were admitted in pursuance to the said provisional
allotments who undertook the studies and are at the verge of
completion of their Post Graduation Degree Course. Further, vide
order dated 18.01.2024, it has already been held that withdrawal
of the permission by NMC was bad. Vide the said order, all the
effective directions have already been issued by the Court.
10. In view of the above, this Court is of the opinion that interim
orders as passed in the writ petitions as filed by the petitioner
College deserve to be confirmed.
11. As a consequence, the petitioners in other writ petitions, that
is, the students admitted with the College and having completed
their Post Graduation course in pursuance to the interim orders,
deserve to be granted PG course certificates by the Rajasthan
University of Health Science (RUHS). Further, those students who
were admitted qua the sessions for the years 2022-23 and 2023-
24 and were not enrolled by RUHS at that point of time, also
deserve to be enrolled and to be allotted a specific enrollment
number. The said students also deserve to be permitted to fill up
their examination forms and participate in the forthcoming
examination.
12. The present writ petitions are therefore disposed of with
the following directions:

I. RUHS shall issue the Post Graduation degree course
certificates to the students who have already completed their post
graduation course, within a period of one month from now;
II. RUHS shall allot specific enrollment number to the petitioner
students who had not been allotted the same earlier;
III. The students who are entitled to appear in the forthcoming
and the subsequent examinations, shall be permitted to fill up the
examination form and to appear in the examination;
IV. The respondents shall not restrain or restrict the said
students in any manner from completing their PG course;
V. The Bank guarantee as deposited by the petitioner College in
pursuance to the interim orders passed in writ petition
Nos.5625/2025 and 5932/2025 as filed by the students shall be
released forthwith by RUHS in favour of the petitioner College;
VI. NMC shall issue permission order in favour of the petitioner
College for the seats as allocated to it in pursuance to the interim
orders of this Court qua the session for the years 2021-22, 2022-
23 and 2023-24.
13. Stay petitions and pending applications, if any, stand
disposed of.
