Judgment

The present second bail application has been filed under

Section 439 Cr.P.C. (Section 483 BNSS). The petitioner has been

arrested in connection with FIR No.49/2023 registered at Police

Station Jamsar, District Bikaner for the offences punishable under

Sections 8/15, 8/29 of NDPS Act.

The first bail application of the accused-petitioner was

dismissed as not pressed with liberty to file afresh after recording

the statement of the Investigating Officer vide order dated

06.11.2023 passed by this Court.

Learned counsel for the petitioner submits that now, the

Investigating Officer has been examined as PW/1. Counsel further

submits that no recovery of contraband has been made from the

petitioner, the alleged recovery has been made from the co-

accused Rajendra @ Chanan and the petitioner has been in judicial

custody since 21.03.2022. Furthermore, the petitioner has been

implicated with the aid of Section 29 of NDPS Act and up to this

time, only 01 prosecution witness out of the total 11 has been

examined. The trial of the case will take sufficiently long time to

be concluded. Therefore, the benefit of bail should be granted to

the accused-petitioner.

Learned Public Prosecutor has opposed the second bail

application.

Having regard to the totality of the facts and circumstances

of the case, I deem it just and proper to grant bail to the accused

petitioner under Section 439 Cr.P.C. (Section 483 BNSS).

Accordingly, the present bail application filed under Section

439 Cr.P.C. (Section 483 BNSS) is allowed and it is directed that

petitioner Deepak Shyokand S/o Sushil, arrested in connection

with FIR No.49/2023 registered at Police Station Jamsar, District

Bikaner, shall be released on bail provided he executes a personal

bond in a sum of Rs.2,00,000/- with two sureties of Rs.1,00,000/-

each to the satisfaction of learned trial court for his appearance

before that court on each and every date of hearing and whenever

called upon to do so till the completion of the trial.
