1. The petitioner happens to be complainant of a case in which

cognizance of the offence was taken which was made to challenge

by the accused respondent by way of filing a criminal revision

petition No.23/2019.

2. Vide order dated 25.04.2022, the learned Court of Revision

remanded the matter back to the learned trial Court to pass a

fresh order after adhering to the mandatory provisions of law.

3. Another petition, bearing S.B. Criminal Misc. Petition No.

7611/2022, between the same parties, has been disposed of by a

co-ordinate Bench of this Court vide order dated 05.04.2024, the

said judgment is reproduced herein below:

We may note here that as far as complaints under Section138 of the NI Act are concerned, this Court in Suo Motu Writ Petition (Criminal)No.2 of 2020 in the case of "In Re: Expeditious Trial of Cases Under Section 138 of N.I.Act,1881"2021 SCC OnLine SC 325 has laid down the guide lines. In clause (3) of paragraph 24 of the said decision, the Constitution Bench has directed as under:

"3) For the conduct of inquiry under Section 202 of the Code, evidence of witnesses on behalf of the complainant shall be permitted to be taken on affidavit. In suitable cases, the Magistrate can restrict the inquiry to examination of documents without insisting for examination of witnesses."

We,therefore,modify the impugned judgment and direct the Trial Court to proceed from the stage of Section 202 of the CRPC. 4. In view of the above and since the issue involved in this case

is similar in nature; therefore, the misc. petition is disposed of in

the same terms as S.B. Criminal Misc. Petition No.7611/2022.
