1. By way of filing the instant criminal misc. petition, a

challenge has been made to the order dated 23.09.2021 passed

by the learned Additional Sessions Judge, Kuchaman City

(hereinafter to be referred as 'the Court of Appeal') in Criminal

Appeal No.45/2021, whereby the sentence of the petitioner was

suspended with the condition to deposit 20% of fine amount

within 60 days, as imposed by the learned Judicial Magistrate,

Kuchaman City (hereinafter to be referred as 'the Magistrate') vide

judgment of conviction and sentence dated 26.08.2021.

2. After hearing learned counsel for the parties and perusing

the material as made available to this Court as well as both the

orders under assail, it is presumed that much water must have

been flawed under the bridge since the order of conviction and

[2025:RJ-JD:3954] (2 of 2) [CRLMP-6937/2021]

sentence, therefore, no case is made out to interfere in the orders

under assail.

3. Accordingly, the instant criminal misc. petition is

dismissed.
