Order
11/08/2025
1. These miscellaneous petitions have been preferred by the
petitioners seeking a direction to club all four cases filed under the
Negotiable Instruments Act and conduct one trial.
2. Learned counsel for the petitioner submits that all four cases
are pending before the learned court below and have been
initiated by the same complainant against the petitioner.
Therefore, the cases may be consolidated so that the trial can
proceed in a smooth, fast and expeditious manner.
3. In support of his submissions, learned counsel has placed
reliance on the judgment passed by the Coordinate Bench of this
Court in Akshay Kalla & Ors. vs. State of Rajasthan & Ors.
[S.B. Criminal Writ Petition No.1732/2023], along with
connected matters decided on 09.10.2024, and prays that the
present matters be considered in the light of the aforesaid
judgment.
4. It is further prayed that the orders passed by the learned
trial court as well as by the learned revisional court, rejecting the
application for consolidation, be set aside, and the cases be
clubbed together. In the alternative, learned counsel prays that
these petitions be disposed of with a direction to the learned trial

court to consider the petitioner's application and to fix all four
cases for hearing on the same date.
5. Per contra, learned counsel for the complainant submits that
all four cases are already pending before the learned Special
Metropolitan Magistrate (N.I. Act Cases) No.9, Jodhpur
Metropolitan, Rajasthan and are being listed on the same date.
Therefore, there is no necessity for consolidation. He further
submits that the learned court below has already dismissed the
application for consolidation and the revision petition filed against
that order have also been dismissed.
6. After considering the facts and circumstances of the case and
upon perusal of the record, these petitions are disposed of with a
direction to the learned trial court to consider the prayer of the
petitioner and ensure that all four cases are fixed on the same
date. It is further expected that the trial court shall decide the
matters expeditiously.
7. Pending applications, if any, also stand disposed of.
