          HON'BLE MR. JUSTICE MUKESH RAJPUROHIT

Order

06/08/2025

It is contended by the learned counsel for the parties that

during the pendency of the criminal proceedings, the parties have

entered into a compromise before the Mediation Center of this

Hon'ble High Court.

[2025:RJ-JD:35543] (2 of 2) [CRLMP-6402/2025]

As per the Mediation Report, the petitioners and the

complainants have amicably settled their dispute with certain

conditions.

Learned counsel for the parties have placed reliance on a

decision of Hon'ble Supreme Court rendered in case of Madhukar

& Ors. Vs. The State of Maharashtra & Anr. (Criminal Appeal

No.7212/2025), wherein it was held that after the compromise, if

allegation levelled against the petitioner was for the offence under

Section 376 of the IPC, then there is no bar on the Court from

quashing the proceedings, the relevant part of this judgments

reads as follows:-

"Therefore, having considered the particular facts and circumstances of this case, and taking into account, the categorical stand taken by the complainant and the nature of the settlement, we are of the opinion that the continuation of the criminal proceedings would serve no useful purpose and would only amount to abuse of process."

In view of the above, the criminal misc. petition filed by the

petitioners are succeeded, thus, allowed and the FIR No.114/2025

registered at Police Station Raipur, District Beawar (Pali) is

quashed and set aside.

The mediation report be taken on record.
