1. Heard.

2. Though number of grounds have been urged, this appeal is

against the interim order dated 20.07.2023 passed in S.B. Civil

Writ Petition No.9913/2023. We find that the impugned order is

[2025:RJ-JD:34457-DB] (2 of 2) [SAW-914/2025]

interim in nature which was passed way back on 20.07.2023

whereas this appeal has been filed in the month of July 2025.

Learned counsel for the appellant sought to convince this Court by

submitting that since the interim order is being continued on every

date of hearing and application for stay still remains pending, the

appellant had to file this appeal. He submits that the appeal has

been filed because the stay application is still pending and neither

the petition has been decided nor the stay application has been

made final.

3. Since the appeal seeks to challenge the interim order dated

20.07.2023, without commenting upon the merits of the issue, we

are not inclined to entertain this appeal. However, we would

request the learned Single Judge either to decide the writ petition

itself expeditiously or in any case if it is not possible to decide the

writ petition, to finally dispose of the stay application after hearing

both the parties as early as possible.

4. Accordingly, the present Special Appeal Writ is disposed of.
