1. Learned counsel for the petitioners submits that the
controversy involved in the present case is squarely covered by a
judgment rendered by Co-ordinate Bench of this Court at Jodhpur
in S.B. Civil Writ Petition No.3873/2019 : Amar Singh vs.
State of Rajasthan & Ors. decided on 20.12.2023.
2. Learned counsel for the respondents is not in a position to
refute the submission made by counsel for the petitioners.
3. In view of the submissions made before this Court, the
present writ petition is disposed of in terms of the judgment
passed by Co-ordinate Bench of this Court at Jodhpur in the case
of Amar Singh (supra).

4. It is made clear that the respondents will be free to examine
the case of the petitioners on their own merit and they will be free
to take a decision against the petitioner, if the facts of the
petitioner are not similar to the case of Amar Singh (supra)
decided by this Court.
